Risk Allocation
Transit perils remain with the cell manufacturer throughout ocean transport, port transfer, and inland haulage. Damage sustained by battery modules during rough sea transit or truck accidents falls entirely under the seller’s commercial insurance coverage. The purchasing party bears zero financial exposure for transport mishaps until physical delivery occurs.
Border Formalities
Import declarations and customs duties remain the exclusive responsibility of the buyer. Delays caused by improper tariff filings, missing cell certifications, or unpaid local taxes do not constitute a breach of delivery by the seller. The buyer indemnifies the carrier against detention charges arising from administrative hold-ups at the port of entry.
Delivery Protocol
Handover takes place at the receiving dock prior to unstrapping and lifting cargo from the transport vehicle. Buyers must supply appropriate offloading cranes and trained personnel to move heavy battery packs safely. Once the unloading process commences, all site risks transfer instantly to the receiving facility.
