Meaning

In the case of direct representation, the customs broker or agent performs the filing but the importer of record carries all the financial and legal responsibility for the accuracy of the data.
Legal Liability
The importer must ensure that all classifications and valuations provided to the agent are correct. If a mistake occurs, the customs authority pursues the importer for the unpaid duties and any associated fines. The broker is only responsible if it can be proven they acted outside the instructions given by their client.
Agency Authority
A written power of attorney is required to establish the right of the agent to act in the name of the importer. This document specifies the scope of the work, the duration of the agreement and the specific territories covered. Without this clear mandate, the customs office will not accept the declaration under this specific representation model.
Documentation Flow
Efficient communication between the battery supplier and the broker is necessary to ensure all technical specifications are available for the filing. The importer maintains the original records of the transaction and must produce them during any subsequent audit. This model is preferred by companies with strong internal compliance teams who want full control over their customs profile.
