Meaning
Legal frameworks prevent traders from evading trade defense measures by slightly modifying goods or shipping through third countries. Application of anti circumvention occurs when evidence shows that the pattern of trade changed following the imposition of duties without sufficient economic justification.
Enforcement Action
National authorities initiate investigations to determine if products originally subject to duties are being routed through a different geography or assembly process. If the investigation proves the intent was evasion, the original anti dumping or countervailing duties extend to the new import stream. This ensures that the protection intended for domestic industry remains effective against predatory pricing.
Detailed audits examine the value added in a third country, requiring that a substantial portion of the manufacturing cost occurs outside the target nation to avoid penalties.
Modification Threshold
Physical changes to the product must be minor to trigger these rules. When a battery pack is disassembled into modules just to bypass a specific tariff on packs, the anti circumvention rules treat the modules as the original taxable item. This prevents companies from using simple technical shifts to nullify trade barriers.
Economic Justification
A claim of circumvention fails if the importer demonstrates a genuine commercial reason for the change in manufacturing or logistics. Legitimate shifts in production capacity or sourcing costs provide a valid defense. The burden of proof rests on the investigating body to show that the primary goal was the avoidance of trade taxes.
